We have attended the Maui County Council meetings to voice our opposition to the proposed increase in the timeshare property tax rate and will continue to keep Maui timeshare owners up to date and informed of the progress relating to that legislation.

New York
Effective May 15, 2012, New York timeshare buyers may elect to receive the voluminous New York Offering Plan in a digital format such as a DVD, CD, USB flash drive, or other format accepted by the Attorney General’s Office as set forth in the new Cooperative Policy Statement.

Missouri
Late last week, the Missouri House of Representatives approved House Bill 1818, which clarifies the status of timeshares for real property tax assessment. It was filed in response to confusion regarding assessments in Taney County (Branson) that date back to 2007. The bill has now moved to the Senate for further consideration.

Hawaii
The Hawaii State Legislature is scheduled to adjourn on Friday, May 4. One bill of particular interest to the timeshare industry, SB 2632 SD1 HD1 CD1, otherwise known as the Land Court Bill, passed both the House and Senate with no further amendments and is now headed to the Governor for signature. A recap of the 2012 legislative session will be posted on www.arda-roc.org after the session adjourns, and a link will be sent out in the next edition of the Insider.

On Friday, April 20, several timeshare industry representatives testified before the Maui County Council to oppose the Mayor’s proposed increase in the timeshare property tax rate from $15.00 to $16.15 per $1,000 of assessed value. The County also became aware that its prior property tax revenue estimates were too low by approximately $6 million. On May 1, the Maui County Council Budget and Finance Committee released its proposed tax increases with a $0.50 increase to the timeshare property tax rate (from $15.00 to $15.50). Another public hearing will be held today, May 3, to specifically address property tax rates. ARDA and ARDA-ROC will continue to testify against any increase to the timeshare tax rate. However, at this time there is no indication that Maui County is interested in cutting spending vs. raising more revenue, and a tax rate increase seems likely.
