Advantage Vacation looks forward to the passage of timeshare consumer protection legislation in all of the States for owners of a timeshare interest and the enactment of laws designed to deter and/or eliminate timeshare scams and fraud in the timeshare industry.

This edition of the Insider focuses on regulatory efforts that have taken place this summer in Nevada, Tennesse and Virgina.  In addition, you’ll find information on the upcoming ARDA West Regional Meeting and the ARDA Southeast Regional Meeting.

Nevada

Due to state agency budget cuts, the Nevada Real Estate Division (NRED) has an inadequate number of reviewers responsible for timeshare filings. NRED staff is also responsible for other filings such as campgrounds and condominiums. This situation has caused substantial delays in the approval of hundreds of timeshare filings. ARDA liaisons met with representatives from the NRED and the Nevada Attorney General’s office in late July to discuss this urgent problem. While short term solutions are still being vetted, ARDA may introduce legislation in 2013 to provide either additional funding for the administration of timeshare filings or an overhaul of the current funding mechanism for timeshare review. The Attorney General and NRED representatives acknowledge the urgency of this matter and are working with ARDA to explore solutions. Following the meetings, ARDA representatives spoke with the Director of the Nevada Division of Business and Industry who was very receptive to short and long term solutions to this problem.

In addition, ARDA-ROC will work with NRED leadership to introduce much needed timeshare resale legislation in 2013.

Tennessee

In late December, ARDA and ARDA-ROC representatives were invited to meet with Tennessee’s Division of Consumer Affairs (DCA), Attorney General’s Office, and Department of Commerce and Insurance to discuss the growing number of alleged consumer complaints in Tennessee that seemed to involve different aspects of the timeshare industry. The group met again in mid-July to continue the discussion.

During the meeting, attendees examined challenges facing the industry, particularly in the secondary marketplace, and agreed to develop a stronger working partnership to benefit timeshare owners who live in Tennessee.

ARDA and ARDA-ROC would like to thank those who participated in this important meeting and look forward to working with the state agencies in the future.

Virginia

In early August, representatives from ARDA, ARDA-ROC, and the Virginia Resort Development Association (VRDA) met with the Counselor and Senior Policy Advisor to the Virginia Governor and other legislative leaders in Virginia to demonstrate the economic impact the timeshare industry provides to the Commonwealth, particularly in the Virginia Beach area, and to build relationships. Representatives from ARDA and ARDA-ROC also met with the Virginia Department of Professional and Occupational Regulation (DPOR) to educate them about the mission of ARDA-ROC, its legislative priorities on behalf of owners around the country, and to learn more about the mission of the DPOR.
