Advantage Vacation received an announcement from the American Resort Development Association (ARDA) announcing the launch of the Government Affairs Insider, a new bi-weekly publication designed to keep timeshare owners informed and up to date on legislative issues and activities affecting the timeshare industry nationwide. Following you will find the announcement reprinted in its entirety.
On behalf of the ARDA and ARDA-ROC government affairs team, we are pleased to announce the launch of the Government Affairs Insider, a new bi-weekly digital publication designed to keep you (the timeshare owner) plugged into the most up-to-date legislative issues and activities affecting the timeshare industry nationwide. In each edition we will include relevant legislative briefings regarding activity we are monitoring.

Arizona
ARDA-Arizona will hold its 12th Annual Legislative Breakfast for members of the Arizona House and Senate (plus staff) on Thursday, March 1, 2012, in the Parlor of the Arizona Capitol Museum in Phoenix.
Arkansas
The Arkansas Real Estate Commission has asked ARDA to work with their staff to develop amendments to modernize the Arkansas Timeshare Act in 2013. ARDA will begin working with the Arkansas Real Estate Commission this year on developing these changes. Any comments or suggestions should be sent to smadsen@arda.org as soon as possible.
Florida
ARDA and ARDA-ROC are in support of the Attorney General’s efforts to pass the Timeshare Resale Accountability Act (HB1001 & SB1408) and continue to work closely with the Attorney General’s office to make sure the language protects Floridaconsumers while promoting a healthy secondary market.
Utah
Representatives of ARDA met with the Utah Division of Real Estate to discuss Utah’s Timeshare and Camp Resort Act and rules relating to timeshare. Progress was made for positive changes sought on behalf of the industry and timeshare owners.
Colorado
With direction from ARDA volunteers, draft legislation has been designed to address timeshare resale in Colorado. It is expected that legislative sponsors will introduce legislation in the next few weeks.
Missouri
Draft language to clarify property tax issues, particularly in Taney County (Branson Area), has been delivered to the potential legislative sponsor for consideration. A bill is likely to be introduced before the end of January.
Massachusetts
In addition to monitoring a variety of bills, ARDA and ARDA-ROC are working on two specific issues involving a question regarding current timeshare conveyance procedures and the effects of a revenue ruling recently released by the MA Department of Revenue regarding the transfer of timeshare estates.
Virginia
ARDA and ARDA-ROC are currently monitoring—in collaboration with the VRDA—three bills of interest that would impact the interests of developers and owners.
Maine
ARDA-ROC is monitoring the actions of local taxing authorities, who have been auditing timeshare resorts’ electric utility bill payments to challenge the current tax exemption that provides timeshare resorts more favorable electric utility rates.
New Hampshire
ARDA-ROC is participating on a Condominium Act Study Committee that began its work in 2011.
Tennessee
ARDA-ROC is monitoring the threat of legislation that would increase property tax rates on timeshare. There has also been an increase in fraudulent resale activity complaints to the consumer affairs division. ARDA-ROC will continue to analyze these complaints and steps that may be taken as a result of these activities.
South Carolina
ARDA is closely following a possible Supreme Court case that could eliminate all sales tax exemptions in the state and multiple legislative tax proposals with the potential to affect the current sales tax exemptions for timeshare exchange as well as the sale of timeshare.
