ARDA announced on Tuesday that Florida’s Timeshare Resale Accountability Act, HB 1001, was unanimously passed in the Business and Consumer Affairs subcommittee.  The Bill was sponsored by Representative Eisnaugle and supported by Florida Attorney General Pam Bondi.

The Government Affairs team of ARDA and ARDA-ROC has been assisting the Florida Attorney General’s Office in the development of this timeshare consumer protection bill.  The bill was amended in committee to provide for several changes to promote a healthy secondary market and to benefit consumers who purchase timeshare services.

Further, the Bill seeks to protect timeshare owners against unscrupulous resale companies who use deceptive practices and to hold those companies accountable for their actions.  The legislation requires timeshare resale companies to disclose complete terms and conditions of their business relationship with a consumer and to provide a right of rescission for consumers who wish to cancel a contract for resale services.  In addition, it will impose penalties on companies that continue to use deceptive practices.

ARDA and ARDA-ROC will continue to support HB 1001 and will work to encourage the passage of the legislation as a means to help protect Florida consumers.  With almost 25% of all timeshare resorts in the United States located in the state of Florida, this proactive legislation is vital to ensuring the long term success of a key sector of Florida’s tourism market.

The Bill HB 1001 is scheduled to be heard in the House Judiciary Committee in the upcoming weeks.  The Senate version of the Timeshare Resale Accountability Act, SB 1408 which is sponsored by Senator Andy Gardiner is scheduled to be heard in the Regulated Industries Committee on January 26 with ARDA and ARDA-ROC representatives present to testify on behalf of the Bill.
